Lumber Liquidators Class Action Lawsuit

This class action alleges that certain Lumber Liquidators hardwood flooring brands contain illegal levels of formaldehyde - a known carcinogen.  This class action seeks among other things to force Lumber Liquidators to replace the alleged contaminated flooring for all US consumers.

Laminate flooring is either resin or fiber board cover by photographic applique layer under a clear protective layer.  Glue is used in the lamination process to fuse these layers together.  The glue can contain formaldehyde.

The complaint alleges that according to recent testing performed by at least three accredited laboratories, Lumber Liquidators’ Chinese-manufactured laminate flooring contains toxic levels of formaldehyde—a poisonous chemical that the United States National Toxicology Program and Europe’s International Agency for Research on Cancer classify as a human carcinogen. In one series of tests, 30 out of 31 boxes of Lumber Liquidators’ laminate flooring contained excessive levels of formaldehyde, with some levels being close to 20 times above the level that is permitted to be sold.

It is hard to know at this stage whether this is a “classable" fact pattern.  Each homeowners situation may be deemed too different given that environmental concerns (ie ventilation, air flow etc) may vary.
